Terms of Service

1. Acceptance of Terms

By accessing or using the beyondthe.city platform (the "Service") operated by Beyond The City SL ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These Terms apply to all users, including travellers, hotel partners, place owners, and community members. Additional terms apply to hotel partners and are set out in Section 10 (Hotel Partner Terms).

2. Description of Service

beyondthe.city is a curated local experience platform serving travellers in Valencia, Spain. The platform provides:

  • A concierge discovery interface for experiences, places, and local events.
  • A community chat and social planning system.
  • A hotel partner program enabling commission-based bookings.
  • An editorial blog and place reviews authored by the community.
  • A live events aggregator sourced from public event data.

3. Eligibility and Account Registration

You must be at least 18 years old to use the Service. By registering, you confirm that all information you provide is accurate and complete.

Account registration is via Google Sign-In (SSO). We do not support password-based accounts. You are responsible for maintaining the security of your Google account. Notify us immediately at legal@beyondthe.city if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Bookings and Payments

Booking process — clicking "Reserve" initiates a Stripe Checkout session. Your booking is confirmed only when payment is successfully processed and you receive a confirmation message.

Pricing — all prices are displayed in Euros (€) inclusive of VAT where applicable. Prices are set by the Company and experience providers and may change without notice.

Cancellations — cancellation policies vary by experience and are displayed at the point of booking. As a general rule: cancellations made more than 48 hours before the experience start time receive a full refund; cancellations within 48 hours are non-refundable unless the experience is cancelled by the provider.

Refunds — approved refunds are processed to the original payment method within 5–10 business days. Contact legal@beyondthe.city to initiate a refund request.

5. User Conduct

When using the platform, you agree not to:

  • Post content that is illegal, defamatory, harassing, hateful, or obscene.
  • Impersonate any person or entity.
  • Attempt to gain unauthorised access to any part of the Service.
  • Scrape or automate access to the platform without written permission.
  • Use the Service to transmit spam or unsolicited commercial messages.
  • Share false or misleading information about places or experiences.

Violations may result in content removal, account suspension, and legal action where warranted.

6. User-Generated Content

By submitting content to the platform (blog posts, place descriptions, community messages, photos), you grant the Company a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute that content in connection with the Service.

You retain ownership of your content and are solely responsible for its accuracy and legality. The Company reserves the right to remove any content that violates these Terms or applicable law, without notice.

7. Intellectual Property

All Company-owned content, design, code, trademarks, and branding on the Service are the exclusive property of Beyond The City SL and may not be reproduced without written permission.

Experience providers retain ownership of their brand assets, images, and descriptions shared with the platform, subject to the licence granted in Section 6.

8. Disclaimers and Limitations of Liability

The Service is provided "as is" without warranty of any kind. We do not guarantee the accuracy of event listings sourced from third-party scrapers, or the quality of experiences operated by independent providers.

To the maximum extent permitted by law, the Company's aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid for the relevant booking in the 12 months preceding the claim.

We are not liable for any indirect, consequential, special, incidental, or punitive damages.

9. Community Features — Chats and Plans

City chats and interest chats are public within the platform. Plan chats are visible to plan attendees and automatically deleted 48 hours after the plan's event date.

We reserve the right to moderate, remove, or restrict access to community features without notice. Rate limiting (10 messages/minute) is applied automatically.

Private chat requests require acceptance by the recipient. You may block any user via their profile.

10. Hotel Partner Terms

Commission model — the Company operates a merchant model. The retail price paid by the guest is split as follows: wholesale cost to the experience provider + platform fee (retained by the Company) + hotel commission. The commission rate is agreed individually during onboarding (typically 10–20% of the retail price).

Payment — commissions are aggregated monthly and remitted via Stripe Connect to the hotel's registered bank account, net of platform fees and any refunds. Payouts occur within 5 business days of the end of each calendar month.

Exclusivity — the Company does not guarantee exclusivity within a city. Multiple hotel partners may operate in the same area.

Partner conduct — hotel partners must not misrepresent the platform to guests, charge guests separately for platform-booked experiences, or interfere with the attribution system.

Termination — either party may terminate the partnership with 30 days' written notice. Outstanding commissions will be paid at the next regular payout date.

11. Governing Law and Disputes

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain.

For consumer disputes, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance. Material changes will be highlighted by updating the effective date.
